Terms of use for D3 Passport (EN primary; DE via language switcher).
1. Scope
These Terms of Use (“Terms”) govern access to and use of D3 Passport (the “Service”), operated by D3 Chain (“we”, “us”). By creating an account or using the Service, you agree to these Terms.
If you use the Service on behalf of a company, you represent that you are authorised to bind that company.
2. Service description
The Service helps companies create, manage, and publish Digital Product Passports (DPPs), including related features such as QR codes, RFC 3161 trusted timestamps, imports, and APIs as offered in your plan.
We may change, suspend, or discontinue features with reasonable notice where practicable. Beta or preview features are provided as-is.
3. Accounts and customer content
You are responsible for account credentials, authorised users, and for the accuracy and legality of product and passport data you upload (“Customer Content”).
You retain ownership of Customer Content. You grant us a limited licence to host, process, and display Customer Content solely to provide and secure the Service (including backups and timestamping).
4. Plans, fees, and taxes
Paid plans are billed according to the pricing shown at checkout (typically via Stripe). Fees are exclusive of applicable VAT unless stated otherwise.
You may cancel a paid subscription according to the process in the billing settings; access continues until the end of the paid period unless otherwise stated.
5. Acceptable use
You must not misuse the Service (including probing, scraping beyond documented APIs, uploading unlawful content, or attempting to bypass security or plan limits).
We may suspend accounts that violate these Terms or create material risk to the Service or other customers.
6. Timestamps, registries, and third parties
Trusted timestamps and any EU registry integrations depend on third-party authorities and networks. We do not warrant uninterrupted availability of those third parties.
Public passport pages may be accessed without login. You are responsible for deciding what data to publish.
7. Warranty disclaimer and liability
Except where mandatory law provides otherwise, the Service is provided “as is” without warranties of merchantability, fitness for a particular purpose, or non-infringement.
To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages. Our aggregate liability for claims arising from the Service in any twelve-month period is limited to the fees you paid us for the Service in that period (or EUR 100 if you are on a free plan).
Nothing in these Terms limits liability for intent, gross negligence, injury to life/body/health, or other liability that cannot be limited under applicable law.
8. Term and termination
You may stop using the Service at any time. We may terminate or suspend access for material breach, non-payment, or legal risk after notice where required.
Provisions that by nature should survive (including liability limits, IP, and confidentiality) survive termination.
9. Governing law
These Terms are governed by the laws of the Federal Republic of Germany, excluding conflict-of-law rules. Mandatory consumer protections in your country of residence remain unaffected.

10. Changes
We may update these Terms. Material changes will be indicated on this page (and by email for material changes affecting paid customers where required). Continued use after the effective date constitutes acceptance where permitted by law.
